Court sentences man to 20 years rigorous RI in POCSO case

Hyderabad: A special court for POCSO Act cases sentenced a 32-year-old person to 20 years rigorous imprisonment (RI) for raping a five-year-old girl at his house in Secunderabad in November 2023. The court also imposed a fine of Rs.20,000 on the accused Lingala Deepak, a labourer and asked him to pay a compensation of Rs.5 lakh to the victim. Special Sessions Judge for POCSO Act cases, B. Pushpalatha, held the accused guilty for the offence punishable under Section 5(m) read with Section 6 of POCSO Act and Section 376-AB of Indian Penal Code (IPC). Accordingly, the court convicted under Section 235(2) of CrPc for offences under Section 376-AB of IPC and Section 5(m) read with Section 6 of POCSO Act and sentenced to undergo RI for 20 years and to pay a fine of Rs.20,000. In default of payment of fine, the court asked the accused to undergo simple imprisonment for a period of six months. In view of Section 42 of POCSO Act, no separate sentence is being imposed against the accused for the offence under Section 376-AB of the IPC. The remand period undergone by the accused shall be set off under Section 428 CrPc against the substantial sentence of imprisonment imposed against him. Having regard to the financial condition and social status, the court considered it appropriate to recommend awarding an amount of Rs.5 lakh to the victim girl, as final compensation, which would help her meet her immediate needs and education. The court directed the Secretary of District Legal Services Authority to take steps to pay the compensation amount to the victim at the earliest.
